Divorce financial orders and the recession
Tuesday, April 14th, 2009The Court of Appeal has made it very clear that the fluctuations in the value of assets we are seeing at the moment are not a reason for a previous court order to be varied. For example the value of the former matrimonial home may have dropped since an order was made and the lump sum due to be paid to the person leaving was based on the original higher valuation. No matter how dramatic the fall in value the Courts have said these Orders will not be overturned.
